This Privacy Policy describes how Kwetu Limited, trading as Kwetu Technologies ("Kwetu," "we," "us," or "our"), collects, uses, and shares information in connection with our Software-as-a-Service (SaaS) platform for WhatsApp marketing, including our website at www.kwetu.co.uk and our related services (collectively, the "Services").
We are committed to protecting the privacy and security of your personal data. We act as a "data controller" for the data we collect directly from you and as a "data processor" for the data you provide to us to process on your behalf.
1. Information We Collect
We collect information to provide and improve our Services. The types of information we collect depend on how you interact with us.
a. Information We Collect Directly from You (As a Data Controller)
- Account and Contact Information: When you register for an Account, we collect your name, business name, email address, phone number, and password.
- Billing and Payment Information: We use a third-party payment processor to handle your Subscription fees. We do not store your full payment card details. We may collect information such as your billing address, payment method type, and transaction history.
- Customer Support Information: If you contact us for support, we will collect the information you provide in your communication, which may include your name, email, and a description of your issue.
- Website and Usage Data: We collect information about how you use our website and platform, such as your IP address, browser type, pages viewed, and the time and date of your visits. This helps us understand how our Services are used and how to improve them.
b. Information We Process on Your Behalf (As a Data Processor)
As a core part of our Service, you upload and provide us with data about your clients. In this capacity, you are the "data controller," and we are the "data processor." This data may include:
- Client Contact Data: Phone numbers, names, and other contact information of your clients, uploaded by you for marketing campaigns and communication.
- Client Message Content: The content of the messages you send to and receive from your clients, which may include text, images, videos, or other media.
- Client Engagement Data: Information on your clients' interactions with your messages, such as delivery status, read receipts, and clicks.
We process this data solely on your instructions and in accordance with your use of our platform. We will never use this data for our own purposes, such as marketing to your clients, without your explicit consent.
2. How We Use the Information We Collect
We use the information we collect for the following purposes:
- To Provide and Operate the Services: To manage your Account, process your payments, and provide you with access to our platform and its features.
- To Facilitate WhatsApp Business API Interactions: We use your business assets, such as your WhatsApp phone numbers and business profile, to connect you to the WhatsApp Business Platform. This allows you to manage your WhatsApp presence, send messages, and access API-related data on your behalf.
- To Run Automated Campaigns and Bots: Our platform uses this data to automate messaging campaigns, manage user groups, and operate AI-powered support assistants as configured by you.
- To Maintain and Improve our Services: We use usage data to analyze and understand how our Services are being used, troubleshoot technical issues, and develop new features and capabilities.
- To Communicate with You: To send you service-related notifications, updates, and marketing communications about our products and services (you may opt out of marketing communications at any time).
- To Ensure Security: To detect, prevent, and investigate fraudulent or unauthorized activities and to maintain the security of our platform and user data.
3. Our Relationship with Meta and the WhatsApp Business Platform
Our Services are built on top of the WhatsApp Business Platform, which is owned and operated by Meta Platforms, Inc. ("Meta"). By using our Services, you understand and acknowledge the following:
- Data Sharing with Meta: To provide our Services, we must interact with Meta's APIs. This means that certain data, such as your business profile information, message templates, and message metadata, is transmitted to and processed by Meta in accordance with their terms and policies.
- Meta's Data Handling: Your use of our Services is also subject to the WhatsApp Business Messaging Policy and other Meta policies. We encourage you to review these policies to understand how Meta processes your data and your clients' data.
- No Access to End-to-End Encrypted Content: While our platform facilitates communication through the WhatsApp Business Platform, we do not have access to the content of end-to-end encrypted messages sent via the consumer WhatsApp app. However, messages sent and received via the WhatsApp Business API are not end-to-end encrypted between your business and Meta. We are able to access this content to provide our Services (e.g., to power our AI bots and customer service features).
4. How We Share Information
We do not sell your personal data. We may share your information with the following third parties:
- Service Providers: We engage trusted third-party service providers to perform functions on our behalf, such as cloud hosting providers, payment processors, and analytics providers. These providers are bound by confidentiality obligations and are only authorized to use your data as necessary to provide services to us.
- Meta Platforms, Inc.: As described above, we share data with Meta as required to access and use the WhatsApp Business Platform on your behalf.
- Legal Compliance: We may disclose your information if required by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect our rights or property, or ensure the safety of our users or the public.
- Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the new owner as part of the transaction.
5. Data Retention
We will retain your personal data for as long as your Account is active or as needed to provide you with the Services. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
As a data processor, we will retain your clients' data only for as long as required by your instructions and the WhatsApp Business Platform's data retention policies. We will securely delete or anonymize this data upon your request or after a reasonable period following the termination of your Subscription.
6. Your Rights
Under the UK GDPR and other relevant data protection laws, you have certain rights regarding your personal data:
- Right to Access: You have the right to request a copy of the personal data we hold about you.
- Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal data.
- Right to Erasure (Right to be Forgotten): You have the right to request the deletion of your personal data under certain circumstances.
- Right to Restriction of Processing: You have the right to request that we limit the way we use your personal data.
- Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format.
